Terms of Service

Effective date: 25 August 2026

1. Who these terms are with

These terms are between you (the label or business operating a Fannera workspace, "you", the "Customer") and Fannera(company no. 17197430), registered office 20 Wenlock Road, London, N1 7GU, England ("we", "us"). By creating an account or using the service you accept these terms.

2. Definitions

  • "Service" — the Fannera platform: fan CRM, releases and drops, smart links, broadcasts, royalties and related features.
  • "Customer Data" — all data you or your fans submit to the Service, including fan contact details, release assets, artwork and audio.
  • "Subscription" — your paid plan as listed on our pricing page.
  • "DPA" — our Data Processing Agreement at fannera.com/dpa.

3. The Service

Fannera provides software for independent record labels to capture fan data, sell music and memberships directly to fans, run email broadcasts, manage royalties and splits, and discover artists. Features available to you depend on your plan as described on our pricing page.

4. Account eligibility

The Service is provided for business use by record labels, artist managers and similar music-business entities. By creating an account you represent and warrant that you are signing up on behalf of a business, that you have authority to bind that business, and that you are not acting as a consumer outside of a trade, business, craft or profession. You must be at least 18 years old.

Accounts identified as consumer sign-ups may be closed at our discretion. You are responsible for all activity under your account and for keeping your credentials secure.

5. Fees and payment

Label plans and prices are listed at fannera.com/pricing and are charged in GBP. You choose monthly or yearly billing at checkout, and the subscription renews on that cycle until it is cancelled. Payments are processed by Stripe; we never see or store your full card details.

New label accounts start with a 14-day free trial. No payment details are collected to begin the trial, and the trial does not convert to a paid subscription on its own. A paid subscription begins only when you choose a plan and complete Stripe checkout; billing starts on the day you complete it. If you do not start a paid plan, the workspace becomes read-only at the end of the trial — your data remains available to view and export. Paid fees are non-refundable except where required by law.

These fees are separate from any paid memberships your fans buy from your artists. Fan memberships are priced by you, paid by the fan, and settled through your own connected Stripe account.

6. Customer data

You own your Customer Data. We process it only to provide the Service, in accordance with our DPA and Privacy Policy. You can export your fan data to CSV at any time, including while leaving.

7. Acceptable Use Policy

You must not:

  • upload or distribute unlawful, infringing or harmful content;
  • scrape, reverse engineer or attempt to bypass the security of the Service;
  • use the platform to send spam or to process personal data obtained unlawfully;
  • misrepresent stream counts, chart positions or other metrics;
  • interfere with other customers' use of the Service.

We may suspend or terminate accounts that breach this policy, with notice where practicable.

8. Your content — warranty and indemnity

You warrant that you own or control all rights to the artwork, audio, video and fan data you upload, and that our hosting and display of that content as part of the Service does not infringe any third party's rights. You indemnify us against third-party claims, damages and costs arising from your content or your breach of this warranty.

9. Intellectual property

Fannera, our brand, and the Service (excluding your Customer Data) are our intellectual property. We grant you a limited, non-exclusive, non-transferable licence to use the Service for the duration of your Subscription. You retain all rights in your Customer Data; you grant us a licence to host, process and display it solely to provide the Service.

10. Service availability

We use commercially reasonable efforts to keep the Service available but do not commit to a specific uptime unless you are on an enterprise plan with a written SLA. Planned maintenance is announced in advance where possible.

11. Third-party services

The Service integrates with third parties including Stripe, Spotify and other music platforms. We do not control those services; changes to their APIs, terms or availability may affect related features. Your use of them is subject to their own terms.

12. Warranties

To the maximum extent permitted by law, the Service is provided "as is" and we disclaim all other warranties, express or implied. Nothing in these terms affects statutory rights that cannot be excluded, including consumer rights where they apply.

13. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with the Service is capped at the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) £100. We are not liable for indirect or consequential loss, lost profit, lost revenue or lost data. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded under English law.

14. Indemnity

You indemnify us against claims, damages and costs arising from your misuse of the Service, your breach of these terms, or your infringement of any third party's rights.

15. Term and termination

Paid subscriptions run on the monthly or yearly cycle you chose and renew until cancelled. You may manage cancellation through the Stripe billing portal, which shows when the cancellation takes effect. When the subscription ends, the workspace becomes read-only rather than being deleted: your data stays available to view and export.

Closing your account is a separate step from cancelling a subscription. When you ask us to close the account, or where we terminate it for breach of these terms, you have 30 days to export your data, after which it is deleted in accordance with the DPA.

16. Confidentiality

Each party will keep the other's non-public information confidential and use it only to perform under these terms, for as long as the information remains non-public.

17. Changes to these terms

We may update these terms. We will notify you of material changes by email in advance; continued use of the Service after the change takes effect constitutes acceptance.

18. Governing law and jurisdiction

These terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction.

19. Miscellaneous

These terms, together with the DPA and Privacy Policy, are the entire agreement between us. If any provision is found unenforceable, the rest remain in force. Failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a merger or sale of the business.
